The question of how to regulate artificial intelligence (AI) has acquainted strange bedfellows(奇怪的盟友), but few odder than Jensen Huang, the billionaire boss of Nvidia, and Lina Khan, a left-wing trustbuster(反垄断斗士) who served as Joe Biden’s chair of the Federal Trade Commission. As debate over restrain(限制,约束)ing large language models (LLMs) becomes more frenzied(疯狂的,狂热的), both Mr Huang and Ms Khan maintain(坚持认为,主张) that rules already on the books(已生效的,法律明文规定的) can deal with most risks. Existing law is sufficient(足够的,充分的), Mr Huang maintained recently. “Apply it.”
It may not be that simple. The question of how current laws govern(管辖,适用于) AI is already the subject of copious(大量的,丰富的) litigation(诉讼), as courts hear arguments over whether chatbots have harmed Americans or facilitate(协助,促进)d crimes. However, it may take years to decide such cases, let alone(更不用说) to use those cases to establish reliable standards. Even then, liability(责任,法律责任) suits mainly deal with harm only after it has occurred.
Both civil and criminal law can apply to cases involving models. Civil tort(民事侵权行为)s such as product liability and libel(诽谤(书面)) come with(伴随,附带) financial penalties. Crimes such as hacking carry potential prison time. But using either legal avenue(途径,手段) is not straightforward(简单明了的,直接的).
